Those who run a company must equip it with adequate organisational, administrative and accounting arrangements and detect a crisis in time. The law does not ask for intentions: it asks for documents, procedures and controls that withstand the scrutiny of a statutory auditor, an external auditor, a bank, a court. Across Europe, the Directive on preventive restructuring asks the same question in every jurisdiction.
The usual answer is a snapshot: a questionnaire, a report, a date. But a company does not stand still, and the day after the snapshot is already old. It is not a problem of rules. It is a problem of means and method.
A necessary clarification
CosAI is not a product of artificial intelligence
In CosAI only the code is artificial. Everything else is human: the idea it comes from, its structure and architecture, its purposes and the people it serves, its functions and every rule that governs each of its aspects. They are the work of the mind and the effort of the person who conceived it and, painstakingly, built it.
Artificial intelligence is the tool. Human intelligence is the guide. That is why people always stay at the centre, and AI at their service.
